Singapore Proposes InternaSingapore tional Committee to Expand Jurisdiction of Singapore International Commercial Court for Cross-Border Dispute Resolution

The Singapore Parliament recently introduced a landmark bill to establish an International Committee within the Singapore International Commercial Court (SICC), aimed at addressing civil appeals and related matters from designated foreign jurisdictions. This move underscores Singapore’s commitment to providing a robust legal framework for managing complex transnational commercial disputes, bolstering the city-state’s reputation as a trusted international legal hub.

Under the proposed legislation, the International Committee will function as an independent body within the SICC, composed of Singaporean Supreme Court judges, SICC’s international judges, and ad hoc representatives from foreign jurisdictions. The Minister for Law will regulate the Committee’s jurisdiction, specifically on civil appeals referred by recognized jurisdictions, while the arrangement also permits representation by Singapore-registered foreign lawyers.

The bill emphasizes the enforceability of the Committee’s rulings, which will be regarded as originating from the courts of referring jurisdictions. This feature will facilitate cross-border enforcement and recognition of decisions, offering a reliable framework for timely dispute resolution. Importantly, decisions made by the International Committee will be final, with no scope for further appeal.

Singapore’s legislative move aligns with its recent international agreements, including the treaty with Bahrain to create the Bahrain International Commercial Court. By establishing the International Committee, Singapore continues to strengthen its international legal partnerships, reinforcing its capacity to resolve global commercial disputes effectively.
