The Madras High Court has issued a directive to YouTube to deposit the entirety of the revenue generated by Savukku Shankar through his videos, which allegedly defamed media company Lyca Productions. This decision comes in response to a civil suit filed by Lyca Productions, seeking damages amounting to ₹1 crore and a permanent injunction against Shankar from making derogatory statements.
Justice N Satish Kumar emphasized that YouTubers do not possess the authority to tarnish the reputations of others and further prohibited Shankar from making any additional unverified allegations against Lyca Productions.
Senior Advocate V Raghavachari, representing Lyca Productions, presented arguments asserting that Shankar had recently published several defamatory videos targeting the media company on his YouTube channel. These videos, shared and viewed over 6,34,000 times, inflicted significant damage to the company’s reputation, according to Raghavachari.
In response to the interim order, the Court instructed YouTube to deposit the revenue earned by Shankar from these contentious videos into the account of the civil suit initiated by Lyca Productions.
The decision underscores the judiciary’s stance against defamation and underscores the legal consequences for disseminating unsubstantiated allegations via online platforms. It serves as a reminder of the responsibility incumbent upon content creators to uphold ethical standards and avoid tarnishing the reputations of individuals or entities.
