The judges emphasized that the objective of Section 509—to safeguard the modesty of women—necessitates an interpretation that aligns with contemporary modes of communication, including emails and social media platforms.

This expanded interpretation ensures that digital insults or derogatory remarks aimed at a woman can be prosecuted under the same provisions used for verbal offenses. This decision is a step toward recognizing and addressing the realities of harassment in the digital age, where harmful actions are often perpetrated online rather than in person.

The court’s decision stems from a case involving Joseph De’Souza, who was accused of sending offensive emails to a female victim in 2009. The emails, containing derogatory remarks about the victim’s character, were circulated among other residents of their housing society, amplifying the insult. The court ruled that these actions fall within the ambit of Section 509 IPC, highlighting that written communications can be equally, if not more, damaging than verbal utterances.

The bench also emphasized the necessity of interpreting statutory provisions in a manner that keeps pace with technological advancements. Inclusion of IT Act and Exclusion of Section 354 IPC

In addition to upholding the application of Section 509 IPC, the court affirmed the inclusion of Section 67 of the Information Technology Act, 2000 in the charges against De’Souza. Section 67 of the IT Act deals with the publication or transmission of obscene material in electronic form, which aligns with the nature of the offensive emails sent by the accused.

However, the court absolved De’Souza of charges under Section 354 IPC, which pertains to the use of physical force to outrage a woman’s modesty. The judges clarified that since the case involved digital communications rather than physical actions, Section 354 IPC was not applicable.
