On Tuesday, the Karnataka High Court dismissed Chief Minister Siddaramaiah’s petition, challenging the Governor’s approval for an investigation into alleged irregularities in the allotment of sites to his wife, B.M. Parvathi, by the Mysuru Urban Development Authority (MUDA). The case centers on the allotment of 14 sites in a prime locality in Mysuru, which reportedly benefited Siddaramaiah’s family.
Justice M. Nagaprasanna, after hearing the case over six sessions, reserved the judgement on September 12. The court’s decision dissolves the interim order that had deferred proceedings in the special court while the petition was under consideration. In the ruling, Justice Nagaprasanna stated that the facts of the case justified the need for further investigation and dismissed the petition.
The investigation, sanctioned by Governor Thaawarchand Gehlot on August 16 under the Prevention of Corruption Act and the Bharitya Nagarik Suraksha Sanhita, 2023, focuses on the improper allotment of compensatory sites under a scheme designed to give landowners developed land in exchange for undeveloped land acquired by MUDA. Allegations suggest that Parvathi had no legal right to the land in question.
Siddaramaiah’s legal team argued that the Governor’s approval for the investigation violated statutory and constitutional provisions, including Article 163 of the Constitution, which requires the Governor to act based on the advice of the Council of Ministers. Senior legal counsel represented both Siddaramaiah and the Governor during the hearings.
This ruling comes as a significant development in the ongoing case against the Karnataka CM, with the court emphasizing the need for a full inquiry into the allegations.
