Chief Justice of India Emphasizes Potential and Pitfalls of AI in Legal Adjudication

Chief Justice of India D Y Chandrachud delivered a keynote address at a conference on Technology and Dialogue between the Supreme Courts of India and Singapore, shedding light on the profound impact of Artificial Intelligence (AI) in the legal domain. While acknowledging the transformative potential of AI, he also cautioned against the complex challenges it presents.

Chandrachud lauded AI’s role in legal research, highlighting its capacity to enhance efficiency and accuracy. He cited instances from Colombia and India where AI, including ChatGPT, had been employed in court adjudication. However, he stressed the need for a thorough examination of the ethical, legal, and practical implications associated with integrating AI into court proceedings.

The Chief Justice emphasized the importance of transparency, accountability, and fairness in AI utilization, expressing concerns about potential errors and biases inherent in AI systems. He warned against instances of ‘hallucinations’ and underscored the impact of bias, particularly in facial recognition technology.

Despite AI’s potential to democratize access to justice and streamline court processes, Chandrachud highlighted the risk of widening inequalities. He noted the possibility of the poor being relegated to inferior AI-driven assistance, exacerbating existing disparities within the legal system.

The conference aimed to explore the intersection of technology and the legal system, with a specific focus on AI’s transformative role in the judiciary. Chandrachud emphasized the need for global collaboration and cooperation to realize AI’s full potential.

He advocated for capacity building and training to ensure the ethical and effective utilization of AI technologies. Chandrachud reiterated the importance of addressing systemic challenges and ensuring that AI serves to enhance, rather than undermine, the pursuit of justice for all.

In conclusion, the Chief Justice highlighted India’s vast opportunities to adopt technology within the judicial system, referencing initiatives such as the e-Courts project aimed at digitizing court processes and enhancing justice delivery across all levels of the judiciary.
