American Eagle Outfitters Files Lawsuit Against Amazon Over Alleged Trademark Infringement for Aerie and Offline Brands

This week, American Eagle Outfitters (AEO) filed a federal lawsuit in Manhattan against Amazon, accusing the e-commerce giant of trademark infringement involving its Aerie and Offline by Aerie brands. The lawsuit claims Amazon has deliberately misled consumers by promoting counterfeit goods through sponsored ads and deceptive search results, using the Aerie name without authorization.

According to the complaint, Amazon’s actions include the “flagrant, unauthorized use” of the Aerie brand, directing customers searching for authentic Aerie products to pages selling “knock-offs and dupes” instead. This has allegedly confused consumers into believing they were purchasing genuine Aerie merchandise, potentially damaging the brand’s reputation.

The lawsuit underscores the broader issue of counterfeit products on digital platforms like Amazon, which has long faced scrutiny for the sale of imitation goods by third-party sellers. American Eagle’s legal action is the latest in a series of lawsuits filed against Amazon, following similar challenges from companies like Birkenstock and Daimler AG in 2016 over the sale of counterfeit versions of their products.

Amazon acknowledged the risks associated with counterfeit goods in its 2019 financial report and has since implemented various anti-counterfeiting measures. These include tools for trademark protection and teams dedicated to enforcement. However, the American Eagle Outfitters lawsuit demonstrates that counterfeiting continues to be a major issue for brands seeking to protect their trademarks and consumers from deceptive practices.

As the battle against counterfeiting persists, American Eagle Outfitters’ legal challenge could set the stage for further action from other brands aiming to safeguard their identity on digital marketplaces.
